These Terms of Service ("Terms") govern your access to and use of First Pass, a macOS application and related cloud services operated by Craft Haus ("Craft Haus", "we", "us", or "our"). By downloading, activating, or using First Pass, or by purchasing a subscription or credits, you agree to these Terms. If you do not agree, do not use First Pass.
1. The service
First Pass is a toolkit for video editors that automates preparation work before an edit — including sorting and organizing footage locally on your Mac, and optional cloud-based AI tools that generate new media from a frame you provide (for example, converting a daytime shot into a day-to-night time-lapse). Some features run entirely on your device; others ("Cloud Features") send data to our servers and third-party AI providers for processing. First Pass requires macOS 14 or later.
2. Accounts and activation
To use paid features you need an active plan and an activation code. Your code activates First Pass on up to the number of Macs included in your plan (currently two). You are responsible for keeping your activation code and account credentials confidential and for all activity under your account. You may deactivate a device at any time from your account to free a seat. We sign in to the website using a one-time email link ("magic link"); anyone with access to your email may be able to access your account.
3. Subscriptions, billing, and trials
Paid plans are offered as recurring subscriptions billed monthly or annually. New subscriptions may include a free trial; unless you cancel before the trial ends, your subscription converts to a paid term and your payment method is charged. Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time; access continues through the end of the period you have already paid for.
Payments are processed by Paddle, our authorized reseller and Merchant of Record. When you buy a subscription or credits, your order is a transaction with Paddle, and Paddle'sbuyer termsalso apply. Paddle handles payment, invoicing, and applicable taxes. We do not receive or store your full payment card details.
4. Credits
Cloud Features are metered in credits. Your plan includes a monthly allotment of credits that resets each billing period and does not roll over. You may also purchase one-time credit top-ups, which do not expire while your account remains active. Each Cloud Feature run deducts a stated number of credits before processing begins.
- Credits have no cash value and are not transferable or redeemable for money.
- If a Cloud Feature run fails before producing a result, the credits for that run are returned to your balance.
- Credits that have been successfully used to generate a result are consumed and are non-refundable.
5. Your content
"Your Content" means the images, video frames, and other material you upload or submit to First Pass. You retain all rights to Your Content.You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely to operate the service and deliver the results you request, including sending it to third-party AI providers that perform the generation.
You represent that you own or have the necessary rights to Your Content and that processing it through First Pass does not violate any law or third-party right. You are solely responsible for the material you upload and for how you use the results.
6. Cloud AI features and generated output
Cloud Features rely on third-party artificial-intelligence models. AI output is probabilistic and may contain inaccuracies, artifacts, or unexpected results; it is provided for you to review and use at your discretion. We do not guarantee that generated output will be fit for any particular purpose. You are responsible for reviewing output before using or publishing it.
Source frames you upload for a Cloud Feature are used only to produce your requested result and are deleted from our processing storage shortly after the job completes. Generated results are stored in your account so you can retrieve them; you can download and remove them.
7. Acceptable use
You agree not to:
- upload content you do not have the rights to, or that is unlawful, infringing, or depicts a real person without appropriate consent;
- use First Pass to create deceptive, defamatory, harassing, or otherwise harmful material;
- attempt to circumvent credit metering, seat limits, activation, or other technical controls;
- reverse engineer, resell, or redistribute the software except as permitted by law;
- use the service to violate any applicable law or the terms of our third-party providers.
8. Intellectual property
First Pass, including its software, design, and branding, is owned by Craft Haus and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use First Pass in accordance with these Terms and your active plan. These Terms do not transfer any ownership in the software to you. As between you and us, you own the output generated from Your Content, subject to the rights of any third-party model provider as described in their terms.
9. Third-party services
First Pass integrates third-party services, including Paddle for payments and AI model providers for Cloud Features. Your use of those features may also be subject to the third parties' own terms and privacy practices. We are not responsible for third-party services.
10. Disclaimers
First Pass is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any result will meet your expectations.
11. Limitation of liability
To the maximum extent permitted by law, Craft Haus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of First Pass. Our total liability for any claim relating to the service will not exceed the amount you paid us (or Paddle on our behalf) for the service in the twelve months before the claim.
12. Termination
You may stop using First Pass and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that risks harm to us, other users, or third parties. On termination, your right to use the software ends; sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of First Pass after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Craft Haus is established, without regard to its conflict-of-laws rules. Nothing in these Terms limits any statutory consumer rights that cannot be waived under the law that applies to you.
